MotorAttend Terms of Service

These Terms of Service ("Terms") govern your access to and use of MotorAttend, a mobile application developed and operated by Lashachi Inc. ("Lashachi," "we," "us," or "our").By downloading, accessing, or using MotorAttend, you agree to these Terms.If you do not agree, you should not use the application.These Terms apply specifically to MotorAttend and not to other products developed by Lashachi Inc.
1. About MotorAttend
MotorAttend is a personal vehicle logbook and memory application designed to help users record, organize, and recall information about their vehicles.Depending on the version and features available, MotorAttend may allow you to:• Create and maintain a vehicle profile.
• Record fuel purchases, oil changes, maintenance, cleaning, and other vehicle-related activities.
• Record dates, odometer readings, costs, and notes.
• Save personal vehicle memories and photographs.
• Create and complete follow-up actions.
• Record resolutions and outcomes.
• Export and restore records using backup files.MotorAttend is intended as a personal organization and recordkeeping tool.It is not a professional automotive inspection, diagnostic, maintenance, insurance, legal, or financial advisory service.
2. Eligibility
You must be at least 18 years old to create an account or use MotorAttend.By creating an account or using MotorAttend, you represent that you are at least 18 years old and legally capable of entering into these Terms.MotorAttend is not intended for use by individuals under 18 years of age. If we learn that an account is being used by an individual under 18, we may take reasonable steps to restrict or terminate the account and address associated personal information in accordance with applicable law.You are responsible for ensuring that your use of MotorAttend complies with applicable laws.
3. Accounts
Some or all TriedThat functionality requires an account.You agree to provide accurate information where requested and to maintain the security of access to your email account and devices.You are responsible for activity occurring through your TriedThat account.If you believe your account has been accessed without authorization, contact [email protected].
4. Personal and Permitted Use
Subject to these Terms and applicable app-store rules, Lashachi Inc. grants you a limited, non-exclusive, non-transferable, revocable licence to use MotorAttend for lawful personal purposes.You may not:• Copy, redistribute, sell, or commercially exploit the application without authorization.
• Attempt to interfere with the security or operation of the application.
• Reverse engineer or modify the application except where permitted by applicable law.
• Use the application for unlawful or fraudulent purposes.
• Infringe the intellectual property or privacy rights of others.You retain ownership of the vehicle records, photographs, and other content you enter into MotorAttend.
5. Accuracy of Vehicle Information
You are responsible for the accuracy, completeness, and currency of the information you enter into MotorAttend.MotorAttend does not independently verify:• Vehicle information.
• Odometer readings.
• Maintenance history.
• Fuel consumption.
• Service completion.
• Expenses.
• Follow-up dates or outcomes.Records stored in MotorAttend are user-generated and should not be treated as independently verified evidence of vehicle condition, ownership, maintenance, or roadworthiness.
6. Vehicle Safety and Maintenance
MotorAttend does not replace:• Manufacturer maintenance schedules.
• Vehicle safety inspections.
• Qualified automotive professionals.
• Official vehicle documentation.
• Applicable vehicle safety requirements.You remain responsible for maintaining your vehicle and complying with applicable laws.Do not rely solely on MotorAttend to determine whether your vehicle is safe to operate.You should consult your vehicle manufacturer's recommendations and qualified professionals when appropriate.
7. Local Storage and Data Responsibility
MotorAttend currently uses a local-first storage design.Vehicle records, memories, photographs, and related information are stored on your device rather than automatically uploaded to Lashachi-hosted cloud storage.You are responsible for protecting your device and maintaining appropriate backups.Local information may be lost because of:• Device damage, loss, or theft.
• Operating-system changes.
• Application removal.
• Storage corruption.
• User error.
• Software or hardware failure.Lashachi Inc. does not guarantee recovery of information stored solely on your device.
8. Backup and Restore
MotorAttend provides a user-controlled ZIP backup and restore feature.You may export supported application records and photographs into a backup file.You are responsible for selecting a secure backup location and protecting the exported file.MotorAttend's current ZIP backups are not encrypted by the application. Anyone with access to an exported backup may be able to view its contents.Restoring a backup may replace existing application records.You should review the application's confirmation messages before restoring a backup and retain separate copies of important information where appropriate.Lashachi Inc. does not guarantee that every backup will be recoverable under all circumstances, including where files are corrupted, incomplete, or incompatible.
9. Free and Paid Features
MotorAttend is being developed with a Free and optional Plus model.The planned Free version includes basic vehicle logbook functionality.The planned Plus version may provide additional functionality, including personal vehicle memories, photographs, follow-up tracking, and other premium features.The availability of paid features may vary by application version, device, and country.At the time of this draft, subscription purchasing and entitlement enforcement have not been implemented in the MVP.Before paid subscriptions become available, Lashachi Inc. will provide applicable purchase terms and subscription information.
10. Future Subscription Terms
If MotorAttend introduces paid subscriptions, the following general principles are intended to apply, subject to the final purchase terms displayed at checkout.• Subscription prices and billing periods will be disclosed before purchase.
• Subscriptions may renew automatically unless cancelled.
• Payments may be processed through Apple App Store or Google Play.
• Subscription management and cancellation will be available through the applicable purchasing platform.
• Cancellation generally prevents future renewal but may not immediately terminate access during a paid billing period.
• Refund eligibility will depend on applicable law and the purchasing platform's policies.
• Any free trial, introductory offer, or promotional pricing will be disclosed when offered.Subscription pricing, renewal terms, and available features will be confirmed before public release.Cancelling Plus is not intended to automatically delete existing local vehicle records or photographs. Continued access to existing information and backup functions will be governed by the app's implemented feature rules.
10. Managing and Cancelling Your Subscription
You can manage or cancel your MotorAttend Plus subscription through the subscription-management settings of the app store through which you purchased it.Cancellation generally stops future automatic renewal. Unless otherwise required by law or the applicable app-store rules, cancelling does not necessarily end access immediately; Plus access may continue until the end of the subscription period for which you have already paid.Deleting the MotorAttend app does not cancel your subscription.Deleting your MotorAttend account does not necessarily cancel your subscription.If you no longer want the subscription to renew, you are responsible for cancelling it through the applicable app-store subscription controls within the time required by that platform.
11. Purchases, Refunds, and Billing Issues
Purchases made through Apple, Google, or another third-party app marketplace are processed by that platform and are subject to its applicable payment, subscription, cancellation, and refund rules.Refund requests for purchases processed by an app store may need to be submitted directly to that app store.Lashachi Inc. may not have the ability to directly issue, approve, or process refunds for transactions handled by a third-party marketplace.Nothing in these Terms limits any refund, cancellation, statutory warranty, or consumer-protection right that cannot legally be excluded.If a purchase or subscription appears incorrectly in MotorAttend you may use the available Restore Purchases functionality or contact [email protected] for assistance.
12. RevenueCat and Subscription Verification
MotorAttend uses RevenueCat to help manage purchases and determine whether an account is entitled to MotorAttend Plus functionality.Subscription information received from RevenueCat and the applicable app store may be associated with your MotorAttend account so that the service can determine whether Plus features should be available.MotorAttend may verify subscription status with its backend rather than relying solely on information displayed by the mobile application.If subscription information cannot be verified temporarily because of an app-store, network, RevenueCat, or other technical issue, some Plus functionality may temporarily be unavailable until entitlement status can be verified or restored.
12. Advertising
MotorAttend may introduce advertising in a future Free version.Any advertising functionality will be subject to applicable laws, platform requirements, and the MotorAttend Privacy Policy.Advertising is not currently implemented in the MVP described by these Terms.
12. Photographs and User Content
You are responsible for the content you choose to record or store in MotorAttend.You should only add photographs or information that you have the right to use.You must not use the application to store or distribute unlawful material or to violate another person's rights.Lashachi Inc. does not claim ownership of your personal vehicle records or photographs.Under the current architecture, pet profile photos are stored locally on your device rather than uploaded to the MotorAttend backend.You are responsible for maintaining your device and any backups you consider necessary.Lashachi cannot guarantee recovery of locally stored photos if application data is deleted, the app is removed, or a device is lost, damaged, reset, or replaced.
13. Intellectual Property
MotorAttend, including its application software, branding, interface, design, and other proprietary materials, is owned by Lashachi Inc. or its applicable licensors.All rights not expressly granted under these Terms are reserved.These Terms do not transfer ownership of MotorAttend or its intellectual property to users.
14. Acceptable Use
You agree not to:• use MotorAttend for unlawful, fraudulent, or abusive purposes;
• attempt to gain unauthorized access to another user's account or memories;
• interfere with or disrupt MotorAttend's systems or security;
• probe, attack, or attempt to circumvent technical restrictions or authorization controls;
•upload, enter, or transmit content that infringes another person's rights;
• use automated systems to abuse or overload the service;
• reverse engineer MotorAttend except to the extent such restriction is prohibited by applicable law; or
• use MotorAttend in a manner that could damage the service or impair its availability to others.
15. Privacy
By using MotorAttend, you acknowledge that you have had an opportunity to review the Privacy Policy.Our collection and handling of personal information is described in the MotorAttend Privacy Policy.
16. Account Deletion
MotorAttend provides functionality to delete your account.Account deletion may permanently remove your account, profiles, server-saved memories, and other account-associated information, subject to legitimate legal, security, backup, fraud-prevention, and compliance retention requirements.Account deletion may also remove locally stored MotorAttend information where supported by the application.Deleting your MotorAttend account does not necessarily cancel an active subscription. You are responsible for separately managing app-store subscriptions.Our account deletion process is described on the Delete Your MotorAttend Account page.
17. Service Availability and Changes
We may modify, update, suspend, limit, or discontinue features of MotorAttend.We do not guarantee that MotorAttend or any particular feature will always be available, uninterrupted, error-free, or compatible with every device or operating-system version.We may perform maintenance, respond to security incidents, change service providers, or modify infrastructure.Where required by applicable law, we will respect rights that cannot legally be excluded.
18. Discontinuation of MotorAttend
We may discontinue MotorAttend in the future.If we decide to discontinue material paid functionality, we will take reasonable steps to provide appropriate notice where practicable and comply with applicable law and app-store requirements.Purchases of MotorAttend Plus do not constitute a promise that MotorAttend or any particular feature will be available indefinitely. If paid functionality is materially changed or discontinued, Lashachi will comply with applicable law and relevant app-store requirements.
19. Third-Party Platforms and Services
MotorAttend relies on third-party platforms and service providers, which may include mobile operating systems, app stores, hosting providers, authentication or email providers, and subscription infrastructure.Your use of those platforms may be subject to separate terms and conditions.
You are responsible for complying with applicable third-party terms.Lashachi Inc. is responsible for MotorAttend to the extent required by applicable law and relevant platform agreements.
20. Lashachi Intellectual Property
MotorAttend, the MotorAttend name and branding, Lashachi branding, software, interfaces, designs, graphics, and other materials provided by Lashachi are owned by Lashachi or its licensors and are protected by applicable intellectual-property laws.Except for rights expressly granted under these Terms, no rights in Lashachi's intellectual property are transferred to you.
21. Availability, Updates, and Changes
Lashachi Inc. may modify, improve, suspend, or discontinue application features.Updates may be necessary to maintain compatibility, security, or functionality.We do not guarantee that MotorAttend will operate without interruption or error on every device.Where reasonably practicable, we will provide appropriate notice of material changes affecting users.We will not intentionally remove user-created local records solely because a user chooses not to purchase a subscription.
22. Feedback
If you voluntarily provide suggestions, ideas, or feedback about MotorAttend, you agree that Lashachi may use that feedback without restriction or obligation to compensate you, subject to applicable law.This does not transfer ownership of your private MotorAttend memories to Lashachi.
23. Suspension and Termination
We may restrict, suspend, or terminate access to MotorAttend if reasonably necessary to:• protect the service or other users;
• respond to security threats or abuse;
• comply with law;
• enforce these Terms; or
• address material violations of these Terms.You may stop using MotorAttend at any time.Lashachi Inc. may restrict access to or discontinue the application where reasonably necessary, including for legal, security, or material violations of these Terms.Removing the application may result in the loss of locally stored records.You are responsible for exporting important records before uninstalling the application where that functionality remains available.
24. Disclaimer of Warranties
To the extent permitted by applicable law, TriedThat is provided on an “as is” and “as available” basis.We do not warrant that the service will be uninterrupted, error-free, completely secure, or that stored information will never be lost.To the extent permitted by applicable law, MotorAttend is provided on an "as is" and "as available" basis.Lashachi Inc. does not guarantee that:• The application will always be available or error-free.
• Records will be completely accurate or recoverable.
• The application will satisfy every user's requirements.
• Reminders or follow-up information, if offered, will always be delivered or displayed at a particular time.
• The application can replace professional vehicle maintenance or safety advice.Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot legally be excluded.
25. Limitation of Liability
To the extent permitted by applicable law, Lashachi Inc. will not be responsible for indirect, incidental, special, or consequential losses arising from the use of MotorAttend, including loss of data, missed maintenance, or interruption of use.Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.Your statutory consumer rights remain unaffected.
26. Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles.Nothing in this section deprives you of mandatory consumer protections or other rights applicable to you that cannot legally be waived.
27. Changes to These Terms
Lashachi Inc. may update these Terms to reflect changes in the application, its features, business practices, or legal obligations.The updated version will display a revised effective date or last-updated date.Material changes will be communicated as appropriate and as required by applicable law.
28. Entire Agreement
These Terms, together with the MotorAttend Privacy Policy and any additional terms presented to you for specific MotorAttend features, constitute the agreement between you and Lashachi concerning your use of MotorAttend.If any provision is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
